On 25th September 2018, the Tribunal made a determination in favour of the Claimant, pursuant to section 68 (4) of the Regulation of Investigatory Powers Act 2000. This determination relates only to the Human Rights Act 1998 complaint that has been made by the Claimant. To summarise, the Tribunal found that:

  1. BPD & BCD data relating to the Claimant was unlawfully held by GCHQ, however they did not access or examine that data:
  2. BPD & BCD data relating to the Claimant was unlawfully held by MI5 , who have accessed or examined such data:
  3. BPD data relating to the Claimant was unlawfully held by SIS, however they did not access or examine that data.
