Wilson v (1) Commissioner of Police for The Metropolis & (2) National Police Chief's Council


On the basis of a witness statement, which they argued complied with their duty of candour, the Defendants invited the Tribunal to proceed to a trial. The Claimant submitted that there had been a failure to comply with the duty of candour and cooperation and argued for orders that the Defendants provide documents in full and conduct further inquiries. The Tribunal did not agree that a full disclosure exercise was necessary or proportionate but also did not consider that what the Defendants had done was adequate. The Tribunal therefore made directions for the provision to the Tribunal of documents in various key categories and consideration of their onward disclosure to the Claimant.
